No DPF so that's good. I would probably remove and store somewhere just in case. That way you can have a custom decat pipe made and liberate a few extra horses.
Best long term solution is to have the insides of the cat stripped and a straight pipe going through it. Leaving it hollow may mess with exhaust flow.
Can the place you're getting g the exhaust from fabricate a fake cat? They'd need to weld something g around the new exhaust to make it look like one. Add any heat Shields that cam e with the original cat and it should look pretty convincing.
As long as you have an under tray fitted they'll have difficulty seeing the cat. They're also not allowed to remove it to look.
When you say "in case mot laws change" do you mean if they devise a test to analyse exhaust gas more closely on diesels? Currently it's an MOT fail if the cat isn't present and the car originally came with one. Hopefully more in depth analysis of diesel exhaust is a few years away yet.
It's illegal now to remove cat if it was on the original specification. I had mine done a year or so ago before they changed the rules , I was worried when it went in for mot but they said nothing nor did I and it passed. The car doea smoke a fair bit now and I am considering putting one back in and having software redone
